STATE LAWS — PUBLIC SECTOR

Who must follow: This ban-the-box law applies only to public sector employers (excluding school districts) in North Dakota.

Timing of inquiry: Public sector employers may not inquire into or consider a candidate’s criminal history until the candidate has been selected for an interview. Exceptions apply for positions at the Department of Corrections and Rehabilitation or employers with a statutory duty to consider a candidate’s criminal history.
